rules that are carried out to the letter are no fun for anyone, neither staff or users, and the past is a good example of that.

We need rules because when an admin talks to a person about something in a thread that is off topic for two pages the thread doesn't get locked, but when I'm off topic for 2 posts it immediately gets locked because I'm 'silly'.
